Terms and Conditions of Use and Acceptable Use Policy (AUP)

“InterVelocity.Net, Inc.” provides Internet Domain Name Registration, Server Co–Location, Dialup and high–speed Internet connectivity, Internet site hosting, reporting, Electronic Mail and other services as specified or agreed to. “InterVelocity.Net, Inc.” maintains certain legal and ethical responsibilities regarding the use of its computer network and equipment involved in these services.

“InterVelocity.Net, Inc.” acts only as a neutral provider of hosting services to the Internet. “InterVelocity.Net, Inc.” has specific ethical concerns regarding the use of its computers detailed below.

Unsolicited Email, Anti-Virus Statement and Electronic Mail Limitations

It is a violation of the AUP to send unsolicited commercial email through servers hosted on our network and also to use unsolicited commercial email to promote sites hosted on our network. This includes the use of third party email services to promote your site. "InterVelocity.Net, Inc." reserves the right to suspend or cancel a customer's access to any or all services provided by "InterVelocity.Net, Inc." when "InterVelocity.Net, Inc." decides that the account has been inappropriately used. We also maintain the right to temporarily suspend service to investigate a report of misuse such as SPAM. Mail Attachments: Emails with the following extensions may be deleted immediately upon receipt to limit the spread of viruses on the Internet and our servers: *.vbs, *.bat, *.scr, *.pif. We limit the size of outbound emails to 10MB in size. "InterVelocity.Net, Inc." reserves the right the cancel service on an account that continually violates the policies specified in this AUP.

Unauthorized use of other people's accounts or computers

“InterVelocity.Net, Inc.” will react swiftly to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include “social engineering” (tricking other people into releasing their passwords), password cracking, security hole scanning etc. Any unauthorized use of accounts or computers by a “ InterVelocity.Net, Inc.” customer, whether or not the attacked account or computer belongs to “InterVelocity.Net, Inc.“, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, according to the seriousness of the attack.

Payment Policies

All pricing is guaranteed for the term of payment received. “InterVelocity.Net, Inc.” will bill in 3 month (quarterly), 6 month (semi–yearly), or 12 month (yearly) cycles. “InterVelocity.Net, Inc.” reserves the right to change prices at any time. Payment is due prior to each anniversary month or period following the date the account was established. Any account not brought current within a week of e–mail notice or exceeding this time frame in any way is subject to suspension. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies “InterVelocity.Net, Inc.” in writing for a request for termination of services. Checks returned upaid (NSF) will be assessed a $20 charge. All payment is in U.S. currency.

Cancellation

“InterVelocity.Net, Inc.” reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro–rated and paid by “InterVelocity.Net, Inc.” if “InterVelocity.Net, Inc.” institutes its right of cancellation. If cancellation is caused by customers violation of these policies, then no refund is due.

Customers can cancel service any time and be refunded any amount exceeding the pre–payment of the current term. Due to security concerns, all account cancellations must be done in writing via US mail or fax with a valid signature of the primary contact of the account, account name, reason for cancellation, user name, and original account password. Payment will be made by company check within 15 days of receipt of cancellation. The account will be cancelled at the end of the current billing period, unless a date of cancellation is specified.

Lawful Purpose

“InterVelocity.Net, Inc.” reserves the right to refuse service to anyone. Customers may only use “InterVelocity.Net, Inc.”'s servers for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. “InterVelocity.Net, Inc.” expressly forbids anyone from using “InterVelocity.Net, Inc.” servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, or any other material which we deem to be objectionable, including, but not limited to, pornography, satanic materials, hacking, warez sites and any and all materials of an adult nature. The designation of any materials as such described above is left entirely to the discretion of “InterVelocity.Net, Inc.” management.

“InterVelocity.Net, Inc.” does permit the sub–selling of your web space provided that all hosting and security concerns are the sole responsibility of the account holder. “InterVelocity.Net, Inc.” also offers a resale program.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold “InterVelocity.Net, Inc.” harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against “InterVelocity.Net, Inc.”, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless “InterVelocity.Net, Inc.” against liabilities arising out of (1) any injury to person or property caused by any products sold or otherwise distributed in connection with “InterVelocity.Net, Inc.”'s server (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party (3) copyright infringement and (4) any defective products sold to customer from “InterVelocity.Net, Inc.”'s server.

Disclaimer

“InterVelocity.Net, Inc.” will not be responsible for any damages your business may suffer. “InterVelocity.Net, Inc.” makes no warranties of any kind, expressed or implied for services we provide. “InterVelocity.Net, Inc.” disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by “InterVelocity.Net, Inc.” and its employees. “InterVelocity.Net, Inc.” reserves the right to revise its policies at any time.

Agreement

Usage of our service constitutes the customer's agreement to this Acceptable Use Policy. New customers must agree to this via electronic methods to obtain new service.

Revisions

"InterVelocity.Net, Inc." reserves the right to revise its policies at any time, without notification.
